Please read this Privacy Policy together with our Terms and Conditions as they set out the terms and conditions for using Swimpion website (“website”), Swimpion mobile application (“application”, “app”) and our services (collectively, the “Services”). If you use our website and/or app, you accept this Privacy Policy and our Terms and Conditions and agree to the terms they set out. If you are under the age of 13, we require that you have parental consent to open an account with us, provide us with your email address and use our website and/or app. You must not use Swimpion website and/or application if you do not agree to our Privacy Policy and Terms and Conditions.

This policy was written in English. To the extent a translated version conflicts with the English version, the English version controls.

Gama Software Ltd, a private limited company based in Edinburgh, UK, owns and operates the internet platform swimpion.com and Swimpion application. Swimpion is an application for keeping track of best swim times, meet results and swimming workouts. The app is suitable for all age groups.

We fully respect your right to privacy when using Swimpion website and application. Here you will find details of our privacy practices and what we do to maintain your right to privacy.

If you have any questions about our privacy practices, this Privacy Policy, or would like to contact us about data protection, you can do so by email.

For Non-EU/EEA Data Subjects:

  • Regardless of where you reside, you can access, correct, export, or delete your personal data (including deleting your entire Swimpion account).
  • You may contact us at any time with questions related to these rights by emailing info@swimpion.com.

For EU/EEA Data Subjects:

  • You have the right to request access to and rectification or erasure of your personal data, the right to object to processing of your personal data, and the right to lodge a complaint with a supervisory authority. Information Swimpion collects

Personal data refers to any information which relates to you as an individual and from which you can be identified, either directly or indirectly. You have the option to use Swimpion app as a guest without providing any personal information. Swimpion collects information about you, including information that directly or indirectly identifies you, only if you choose to share your personal information with Swimpion.

Where you choose to open an account with us and agree to share your personal data with us, we collect account information that helps provide you with access to our Services:

  • Your name (can be username),
  • Your email address,
  • Password,
  • Gender (optional, for FINA points calculation only),
  • Weight (optional, for burned calories calculation only).

Profile, activity, and usage information is collected about you when you engage in activities such as choosing to upload a photo or log an activity (including date, time and geolocation information, as well as your swim pace and perceived exertion), join a challenge, or otherwise use the Services.

When you use our Services, we collect information from and about the computers, phones, tablets and other web-connected devices you use to access our Services. Information we obtain from these devices includes:

  • Device attributes: information such as the operating system, hardware and software versions, browser type.
  • Network and connections: information such as the name of your mobile operator or ISP, language, time zone, IP address, connection speed.

We use Google Analytics to monitor app and website usage and evaluate the effectiveness of our Services. This information is not personally identifiable. We chose third party providers that we use very carefully who will provide the same protection of your data as stated in this Privacy Policy.

We make no attempt to identify individual users of our Services, unless we suspect that unauthorised access to our systems is being attempted. We reserve the right to attempt to identify and track any individual who is reasonably suspected of trying to gain unauthorised access to our computer systems. As a condition of using our Services, all users give us permission to use their access logs to attempt to track users who are reasonably suspected of gaining, or attempting to gain, unauthorised access.

How Swimpion Uses Information

Swimpion uses the information we collect and receive to provide the Services, including but not limited to:

  • Saving your swimming information for you to be able to access it at a later time and on multiple devices;
  • Allowing you to create multiple accounts;
  • Allowing you to log and manage your training and analyse your performance;
  • Managing your enquires, requests and complaints;
  • Providing opportunities to give us feedback about our Services;
  • Providing you with notifications you have opted in to receive;
  • Visualising your training logs in new ways;
  • Customising your experience;
  • Allowing you to comment on our social media pages;
  • Conducting data and statistical analysis to monitor performance of our services and make improvements;
  • Using some of your data for the purpose of market research, and for the purpose of advertising on our app.

Looking after your information

Swimpion does not sell personal information or aggregated data for monetary value.

The principles of the General Data Protection Regulation (GDPR) require us to make sure your data is accurate, kept up-to-date and that is kept for no longer than is necessary.

We choose our third-party providers (Google Analytics) carefully to ensure they offer the same level of data protection as stated in this Privacy Policy.

Swimpion implements measures to ensure that your information is treated securely and consistently with the terms in this Privacy Policy. In addition, you can take steps to protect your account and information such as creating a unique password for Swimpion that is not easily guessed and that you do not use anywhere else, not sharing your password with others, and promptly reporting suspicious activity or unauthorized account access.

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is compelled by or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process, or otherwise permitted by law.

We may share your data with actual or potential buyers (and their agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your data only for the purposes disclosed in this Privacy Policy.

Your legal rights and closing your account

You can delete your account and user data at any time. Please note that if you delete your account, you will not be able to access it on any other device. If you change your mind and decide to re-join Swimpion again, we will not be able to retrieve your old data.

Privacy laws provide certain rights to users in certain jurisdictions. Under the General Data Protection Regulation (GDPR), you have the right to access, rectify, and erase your data:

  • You can request more details about the information we collect about you and how and why we use it;
  • You can have your information corrected or deleted. You can update your information on your profile or delete your data by closing your account;
  • You can object to us processing your information. You can ask us to stop using your information, including when we use your information to send you marketing emails or push notifications. If you opt out of receiving marketing messages from us, we may still send you updates related to your account.

Cross Border Data Transfers

If you are located outside of the United Kingdom and choose to use the Services or provide information to us, you acknowledge and understand that your information will be transferred, processed and stored in the United Kingdom, due to the provision of Services being provided from and data storage facilities being located in the United Kingdom.

Cookies Policy

Cookies are small text files containing a string of characters that can be placed on your computer or mobile device that uniquely identifies your browser or device. Cookies allow a website or services to know if your computer or device has visited it before.

We use cookies, including but not limited to:

Swimpion reserves the right to modify this Privacy Policy at any time. Any changes we may make to our Privacy Policy in the future will be posted on this page. Use of information we collect from you now is subject to the Privacy Policy in effect at the time such information is used. You are bound by any changes to the Privacy Policy when you use our Services after such changes are first posted. If you object to any changes to this Privacy Policy, you should stop using the Services and delete your account.
